How often is a trademark renewed?
A registration is valid for ten years from the filing date and can be renewed repeatedly, each time for a further ten years. The renewal must be carried out within the statutory window around the end of validity. Miss it and the mark lapses, and the brand you spent years building can be registered by someone else. That is why we track the deadlines for you.
What does trademark monitoring of conflicting applications involve?
We continuously watch newly filed trademark applications and compare them with yours. If a sign appears that could be confused with your brand, we flag it in good time so you can file an opposition. After an application is published only a short period runs, and once it passes only the slower route through the courts remains.
When do I need a trademark assignment?
Typically when selling a company or part of it, restructuring a group, moving a brand to another company or in an acquisition. For the change of owner to take effect externally, it has to be entered in the register. We prepare the trademark assignment agreement and the materials for the entry so that rights pass without gaps.
How does a trademark licence work?
A licence lets another party use your brand on agreed terms, for example a franchisee, distributor or subsidiary. The trademark licence should clearly define the scope, territory, term and quality control, so that use does not weaken the value of the brand. A licence can also be entered in the register.
Can you take over a portfolio that was set up elsewhere?
Yes. We start with an audit: an overview of which marks you actually own, where they are valid and when they come up for renewal. We uncover gaps and needlessly maintained registrations and propose how to make the portfolio clearer and keep it valid. Taking over management is a common first step for clients who have not actively tended their marks for years.
